Lawyer at the ECHR

Judicial practice contains many cases when, unfortunately, the state is unable to ensure adequate protection of the rights and freedoms of its own citizens in national level courts.

In such cases, an effective tool for protection is an appeal to the European Court of Human Rights (ECHR), an international judicial body whose jurisdiction extends to all member states that have ratified the Convention for the Protection of Human Rights and Fundamental Freedoms, including Ukraine.

Do you even need a lawyer to apply to the ECHR?

The subject of a complaint can only be rights and freedoms guaranteed by the Convention on the Protection of Human Rights and Fundamental Freedoms or its protocols.

The complaint must be submitted no later than 4 months after the final consideration of the issue by the national court. This term cannot be renewed.

In order for the complaint to be recognized as admissible on its merits, the applicant must use all domestic means of protecting his right, and primarily judicial means of such protection. For Ukraine, exhaustion of national remedies is considered to be the applicant's passing through the first, appellate and cassation court instances.

A complaint to the ECtHR can be submitted in the national language, however, further communication with the court will be conducted in one of the two official languages: French or English.

In general, the procedure for applying to the ECHR is quite complex and has its own nuances. This is one of the key reasons why it is necessary to enlist the help of a lawyer in such a case.

The cost of a lawyer's services at the ECHR

The amount of a lawyer's fee is quite complex and, as a rule, is set individually for each specific case. This is due to a number of factors, including but not limited to:

  • The complexity of the matter. The more complicated the case, the more effort and time the lawyer needs to spend on making a decision.
  • Collection of evidence. It depends on how easy or difficult the process of obtaining them is.
  • Time frames. If the case requires immediate intervention or a short-term solution, this may also affect the amount of the fee.
  • Experience as a lawyer. ЕThe expertise of a lawyer significantly increases the chances of a successful resolution of the case.

Therefore, the amount of the lawyer's fee is quite flexible and individual in each specific case and is usually discussed during the first consultation with the client.
